​1. Definitions

 

1.1. Customer: the party who has inquired or bought the charter.

 

1.2. Agency/Charter Agency/Agent: Global Sails Ltd.

​

1.3. Charter Operator/Principal: the owner of the yacht or an operator authorised to act on the owner’s behalf.

 

1.4. Charter Contract/Agreement: also called “General Terms and Conditions” by charter companies, is a contract/agreement between the customer and Charter Operator.

 

1.5. Skipper: the designated person who holds an approved licence and who is responsible for the vessel and for the safety of the crew and passengers during the charter.

 

1.6. Booking Summary: a document sent from the Agent containing but not limited to the points of departure/return, security deposit amount, date of charter and initial deposit payment dates.

 

1.7. Agency Agreement: the agreement between the Customer and the Agency regarding the arrangement and booking process of the bareboat charter.

 

2. The Agency’s Roles and Responsibilities

 

2.1. The Agency solely acts as an intermediary between the Customer and the Principal.

 

2.2. Any verbal agreement must be confirmed in writing by email.

 

2.3. The Agency is responsible for ensuring, via agreements or consultation, that the charter company can and agrees to provide any extra services arranged with the customer. If these services involve deviations from the charter contract, the contract must be updated accordingly.

 

2.4. The Agency shall take reasonable steps to ensure that any Charter arranged for the Customer is performed in line with the Charter Agreement and the terms of this Agency Agreement. The Agent is accountable only for losses or damages directly caused by its own or its employees’ negligence or default and assumes no liability for the Principal or the Principal’s duties under the Charter Agreement.

 

2.4. The Customer acknowledges and agrees that the Agent shall not be liable for any loss, damage, inconvenience, or disruption resulting from the actions or failures of independent third parties, or from force majeure events, including but not limited to war or the threat of war, riots, civil unrest, terrorist acts, industrial disputes, unavoidable transport issues, airport closures or congestion, natural or nuclear disasters, fires, adverse weather, orother factors over which the Agent has no control or authority.

 

3. The Booking Process

 

3.1. The Customer warrants that they are at least 18 years of age to book any service through our Agency and accepts our terms and conditions.

 

3.2. Any verbal agreement must be confirmed in writing by the Agency.

 

3.3 Once the booking summary has been sent to the Customer, the Principal will reserve the vessel for a stated period (usually 48-72hrs).

 

3.4. Once the Customer has signed the booking summary and pays the initial deposit, the charter is deemed booked and the Charter Agreement commences. Payment of the initial deposit shall be regarded by the Agent and Principal as acknowledgment and acceptance of the Principal’s Charter Agreement by the Customer.

3.3. The Customer may have to pay the full charter amount if the booking is close to the departure date. This payment schedule will be stated in the Principal’s charter agreement.

 

4. Changes & Cancellation

 

4.1. If the Customer wishes to amend their booking, the Agency will try to assist with implementing the changes subject to the availability and engagement from the Principal.

 

4.2. Any extra charges or fees will be payable by the Customer.

 

4.3. Any amendments to the booking will be confirmed via email.

 

4.4. The Customer is entitled to cancel the charter. Cancellations will be handled according to the cancellation clause in the Principal’s Charter Agreement with the Customer, along with any associated cancellation fees.

 

4.5. The charter will be deemed “cancelled” once the Customer receives written confirmation from the Principal via the Agent.

 

5. Security Deposit

 

5.1. At check-in, the Customer will leave a security deposit with the Principal. The security deposit and amount will be stated in the booking summary along with the accepted payment methods.

 

5.1. At the Principal’s discretion, the security deposit may be used to cover any damages or property losses incurred during the charter. It will also cover any additional cleaning services required if the vessel is returned in a poor state.

 

5.2. The security deposit is between the Customer and Principal. The Agent assumes no liability if the Principal fails to refund the Security Deposit to the Client at the end of the charter and is not responsible in any way for any loss of, or deductions taken from, the deposit.

 

6. Bareboat Experience Requirements

 

6.1. If the Customer wishes to book a bareboat charter, the Skipper identified on the booking needs to have sufficient sailing experience and the required licence to operate the size and type of vessel and must be accompanied by one other adult. Some sailing areas also require the Skipper to have a VHF certificate of competence or radio licence. It is the Customer’s duty to check that the Skipper has an approved certificate of competence in accordance with regulations set by the authorities in the relevant sailing areas.

 

6.2. If the Principal determines that the Customer or the appointed Skipper is not sufficiently competent to operate the vessel, the Principal has the right to require the Client to hire a Skipper of the Principal’s choosing at the Client’s expense or may decline to charter the yacht and cancel the booking in line with the Charter Agreement.

 

7. Information Presented

 

7.1. The information presented on our website regarding the vessels is provided by the Charter Operators. The Agency cannot guarantee or verify that all the information and photos are correct and there may be differences between the website and the yacht chartered.

 

7.2. The Customers acknowledges that the Agency is not reliable for the correctness of this information.
